The CPUC has finally responded to a constitutional challenge raised by Cowlitz PUD against the renewable portfolio standard. After waiting two and a half years, the CPUC rejected the claim that the rules violate the Commerce Clause of the United States Constitution. Cowlitz believes the organization discriminated against out of state renewable energy facilities with this legislation, a belief that the CPUC vehemently denies.
There are 30 days for Cowlitz to appeal the decision to state court.
